International owner or Maltese shipping company
For an International Owner to register a vessel under the Malta flag, it is required for them to either; appoint a Resident Agent or Establish a Maltese Shipping Company.
Resident Agent
a) Appoint a “Resident Agent” in Malta for the purposes of Regulation 4 (1) of the Merchant Shipping Regulations.
The resident Agent will effectively be empowered by the international Owner to act, sign and file documentation with the Maltese Authorities with respect to the registration of a vessel under the Malta Flag.
The International Owner would also be required to deliver a “Declaration of Appointment of Resident Agent” as well as A “Legal Opinion” and a “Good Standing Certificate” to the Malta Register.
Maltese Shipping Company
b) Establish a Maltese Shipping Company* to own the vessel which is to be registered under the Malta Flag.
A suitably worded “Power of Attorney” by the directors of the Maltese company would be required in order to empower Flagport representatives to act, sign and file documentation with the Maltese Authorities with regard to the Registration of a vessel under the Malta Flag.
